OutKast/Rosa Parks Pretrial Decision Reversed
On Monday (May 12) an appeals court ruled that Rosa Parks can go ahead with a lawsuit against OutKast for using her name as the title of one of their hit songs on their 1998 album, Aquemini. The three-judge panel in Cincinnati sent Parks' false advertising and publicity claims back to U.S. District Judge Barbara Hackett in Detroit. In sending the decision back, the judges reversed Hackett's finding for OutKast in a 1999 pretrial decision.
Rosa Parks' lawyer said, "This actually has reaffirmed the rights of other citizens in the United States that others should not appropriate one's name for profit without one's consent. It's another stand for which Mrs. Parks has stood tall." The civil rights pioneer, who is now a Detroit resident seeks to have her name removed from future versions of the disc.
